Terms of Service
Effective Date: October 20, 2026 · Last Updated: October 19, 2026
1. Introduction
Welcome to WeScale.ai (“Service”), operated by WeScale (“Company,” “we,” “us,” or “our”). WeScale.ai is a web-based tool designed for print-on-demand (POD) store owners to upload designs, generate product mockups, create and publish products to their connected stores, see business performance from their connected platforms, and get AI assistance.
By clicking to accept, creating an account, or accessing or using the Service, you (“User,” “you,” or “your”) agree electronically to the version of these Terms of Service (“Terms”) presented to you at that time. If you do not agree, do not use the Service. We may update these Terms from time to time. We will provide reasonable advance notice of material changes through the Service, by email, or by another reasonable method, and will request renewed acceptance when required by applicable law or when the nature of the change warrants it. Unless otherwise stated, changes become effective on the date identified in the notice and apply prospectively.
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding agreement. By using the Service, you represent that you meet these requirements and that you are authorized to act on behalf of any business entity under which you operate.
3. Account Registration and Security
3.1 Account Creation
To use the Service, you must register an account using a valid email address. We use a passwordless authentication system — a one-time 6-digit sign-in code, which expires after one hour, is sent to your email each time you log in.
3.2 Account Responsibilities
You are responsible for:
- Maintaining the security of the email account used to access the Service.
- All activity that occurs under your account.
- Promptly notifying us at support@wescale.ai if you suspect unauthorized access.
3.3 Third-Party Platform Connections
The Service integrates with third-party platforms including Shopify, Meta, Klaviyo, and Printify. When you connect a platform, you authorize us to access, retrieve, use, store, update, and, where you direct us, transmit or modify platform data as necessary to provide the Service, subject to the permissions you grant and the applicable platform’s terms. Depending on the platform and enabled features, this may include:
- Store your API tokens in encrypted form for the purpose of operating the Service on your behalf.
- Access Printify shop and catalog information, products, artwork, mockups, production costs, shipping rates, order production details, and shipment data. Recipient names, email addresses, phone numbers, and street addresses included in Printify order responses are removed before storage; only business and destination country or region information used by the Service is retained.
- Access Shopify products, media, variants, delivery profiles, metaobjects, aggregate sales and traffic metrics, product-level performance, and marketing attribution data. Although the permissions granted through Shopify may technically permit access to protected customer data, the Service is designed not to collect or store Shopify customer records or order-level records containing shopper names, email addresses, phone numbers, or street addresses.
- Access Meta advertising account information on a read-only basis, including campaign, ad-set, and ad structure and settings; aggregate performance and attribution metrics; targeting configurations selected by you; tracking-pixel identifiers; and ad creative content, including text, images, carousel content, and video thumbnails. We may retain copies and dated versions of creative media to provide historical reporting, but do not receive data identifying individual viewers from Meta.
- Access Klaviyo campaign and flow information, audience names and counts, aggregate delivery and engagement metrics, attributed revenue and conversion counts, and marketing-email content and media, including dated versions where content changes. We do not collect Klaviyo subscriber profiles or order events containing shopper personal information.
- Create, update, publish, and delete products and media on connected platforms as directed by you through the Service.
You are responsible for ensuring that your use of these third-party platforms complies with their respective terms of service and that you have authority to connect the applicable accounts and instruct us to process their data. Platform permissions and available data may change, and platform disconnection may limit or disable related Service features and trigger deletion as described in these Terms, our Privacy Policy, the applicable Data Processing Agreement, and applicable platform requirements.
4. Description of Service
WeScale.ai provides the following capabilities:
- Upload design files from your device and prepare them for printing.
- Generate product mockup images from your designs and download them individually or as ZIP archives.
- Create print-on-demand products on Printify from your designs, with configurable products, print providers, variants, and placements.

- Browse, search, filter, download, and delete your design assets.
5. Intellectual Property
5.1 Your Content
You retain all ownership rights to the designs, images, and other content you upload to or create through the Service (“Your Content”). We do not claim any intellectual property rights over Your Content.
By uploading Your Content, you grant us a limited, non-exclusive, worldwide license to store, process, transform (e.g., format conversion, resizing, compression), and transmit Your Content solely for the purpose of providing the Service to you. This license terminates when you delete Your Content or your account.
5.2 Representations and Warranties on Content
You represent and warrant that:
- You own or have the necessary licenses, rights, and permissions to use and upload Your Content.
- Your Content does not infringe upon the intellectual property rights, privacy rights, or other legal rights of any third party.
- Your Content does not violate any applicable laws or regulations.
5.3 Our Intellectual Property
The Service, including its software, design, features, and documentation, is owned by WeScale and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand elements.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Upload content that is illegal, infringing, defamatory, obscene, or harmful.
- Attempt to gain unauthorized access to the Service, other accounts, or connected systems.
- Interfere with or disrupt the Service’s infrastructure or security mechanisms.
- Use the Service to send spam, phishing, or unsolicited communications.
- Reverse-engineer, decompile, or attempt to extract the source code of the Service.
- Resell, sublicense, or provide access to the Service to third parties without our consent.
- Circumvent any rate limits, usage restrictions, or security measures.
- Use automated scripts, bots, or crawlers to access the Service except through our provided APIs.
7. Third-Party Services
7.1 Integrations
The Service integrates with third-party platforms including but not limited to Printify, Shopify, Meta, Klaviyo, Google Drive, and Cloudflare. Your use of these platforms is governed by their respective terms of service and privacy policies. Except to the extent a loss results from our breach of an express obligation under these Terms, the applicable Data Processing Agreement, or applicable law, we are not responsible for the independent practices, availability, security, or content of third-party services that we do not control. Nothing in this section limits responsibility that cannot lawfully be excluded.
7.2 API Token Handling
When you provide API tokens or authorize OAuth connections for third-party platforms, we encrypt and store these credentials using industry-standard encryption. We never store plaintext API tokens.
7.3 Third-Party Availability
We do not guarantee the availability or performance of third-party services. If a third-party service experiences downtime, rate limiting, or API changes, portions of the Service may be temporarily unavailable or degraded.
7.4 Meta Platform Integration
When you connect your Meta (Facebook / Instagram) account through the Service’s OAuth flow, you authorize WeScale to use read access to your ad accounts, granted through Meta’s business login, to retrieve and store the account, campaign, ad-set, ad, performance, attribution, settings, targeting-configuration, pixel-identifier, and creative-content data described in these Terms and our Privacy Policy for reporting, historical analysis, and other features provided to you within the Service. This may include copies and dated versions of ad text, images, carousel content, and video thumbnails. WeScale never creates, edits, pauses, or otherwise modifies your ads, audiences, pixels, business settings, or other Meta assets, and does not receive information identifying individual ad viewers from Meta. The access token stays valid until you disconnect Meta from the Service or remove WeScale from your Facebook app settings.
Use of Meta data within the Service is subject to the Meta Platform Terms (https://developers.facebook.com/terms/) and Meta Business Tools Terms (https://www.facebook.com/legal/terms/businesstools). You can disconnect Meta from the Service at any time through Settings. Removing WeScale from your Facebook app settings triggers our automated Data Deletion webhook; associated Meta data will be deleted within 30 days, except to the limited extent retention is required by law. Additional details and deletion-request instructions appear in our Privacy Policy (https://app.wescale.ai/privacy).
7.5 Printify Integration
When you connect your Printify account, the Service operates as an application that accesses your Printify shop. WeScale is solely responsible for the Service. Printify is not liable for any fault in the Service or any harm that may result from its installation or use. Printify cannot provide assistance with the installation or use of the Service. WeScale is solely responsible for any liability which may arise from your access to or use of the Service, including (a) the development, use, marketing or distribution of or access to the Service, including support of the Service; and (b) WeScale’s access, use, distribution or storage of your Printify merchant data.
8. Service Availability and Modifications
8.1 Availability
We strive to maintain the Service’s availability but do not guarantee uninterrupted or error-free operation. The Service is provided on an “as-is” and “as-available” basis.
8.2 Modifications
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of significant changes.
8.3 Beta Features
Certain features may be labeled as “Beta” or “Experimental.” These features are provided for testing and feedback purposes and may be modified, restricted, or removed at any time without notice.
9. Data Processing Agreement
To the extent WeScale processes personal data on your behalf, the separate WeScale Data Processing Agreement (“DPA”), as updated in accordance with its terms, is incorporated into and forms part of these Terms. If these Terms and the DPA conflict, the DPA controls solely with respect to the processing of personal data; these Terms control in all other respects. Any additional platform-specific data-protection obligations that apply to WeScale remain applicable according to their terms.
10. Confidential Merchant Information
10.1 Use
“Confidential Merchant Information” means nonpublic information submitted by or obtained for you through the Service concerning your business, including sales and performance history, product and pricing data, designs, marketing strategies, advertising and email content, platform credentials, and account settings. We will use Confidential Merchant Information only to provide, secure, support, and maintain the Service for you, to comply with law, and as otherwise expressly authorized by you. We will protect it using reasonable administrative, technical, and organizational safeguards and will disclose it only to personnel and service providers who need it for those purposes and are bound by confidentiality obligations. Confidential Merchant Information does not include information that we can document: (a) is or becomes public through no breach by us; (b) was lawfully known to us without restriction; (c) is received lawfully from a third party without a duty of confidentiality; or (d) is independently developed without use of your Confidential Merchant Information.
10.2 Lawful Requests
We may disclose information in response to a subpoena, court order, or other governmental request only when we reasonably believe disclosure is legally required. Unless prohibited by law or an emergency involving risk of serious harm, we will give you notice reasonably sufficient to seek protective relief. We will disclose only the minimum information reasonably necessary to comply and, where appropriate, seek confidential treatment or narrow an overbroad request.
11. Data Retention and Account Deletion
11.1 Data Retention
We retain account data, historical business data, marketing content, platform data, and dated versions for as long as your account or the relevant connection remains active and as reasonably necessary to provide the Service. We then delete or de-identify data in accordance with our Privacy Policy, the applicable DPA, legal requirements, and the requirements of each connected platform. Data retrieved from a connected platform is deleted: when you disconnect a platform, we keep the data already retrieved for 30 days, so that reconnecting restores your history, and then delete it; when you uninstall or remove WeScale from a platform, or when you or the platform requests deletion, including through a valid Shopify store-deletion request, we delete the covered platform-derived data within 30 days. Limited information may remain temporarily in routine backups until overwritten under our backup schedule, or longer where required by law, provided it remains protected and is not used for other purposes.
Temporary data (such as ZIP download files) is automatically deleted after 24 hours.
11.2 Account Deletion
You may permanently delete your account at any time in Settings → My Account. Within 30 days, account deletion will:
- Remove all your design assets from our file storage.
- Remove all your generated mockup files.
- Destroy all encrypted API tokens and credentials.
- Delete your profile data, import history, presets, and all associated records.
- Remove your authentication identity from our system.
Account deletion is irreversible. Records of your acceptance of these Terms are kept after account deletion for as long as needed to resolve disputes. Products already created on Printify or published to Shopify will not be affected by account deletion — those must be managed directly on those platforms. Disconnecting a platform revokes our ongoing access and may disable related dashboards, synchronization, publishing, reporting, or other features. Unless deletion is required sooner by the platform or law, data already retrieved remains available for 30 days, so that reconnecting restores your history, and is then deleted under the retention rules above. Removing WeScale through a platform’s settings triggers deletion of the data retrieved from that platform within 30 days, including Meta data and data covered by a valid Shopify erasure request.
11.3 Product Analytics and Session Recordings
To operate, support, and improve the Service, we may collect product analytics about pages visited, features used, and action outcomes, and may use session recordings that replay navigation within the Service and what is shown on screen. Form-field input and other designated sensitive fields are masked before recording data leaves your browser. This data is processed by our product-analytics provider on our behalf, is not sold, and is not shared for advertising. Our Privacy Policy provides notice about these practices; acknowledging or receiving that notice is not itself consent. Where applicable law requires consent for non-essential analytics or session recordings, we will not activate them until you give separate, affirmative consent through the applicable control, and we will provide a separate session-recording choice where legally required. You may withdraw consent or turn these features off at any time under Settings → My Account, without affecting core Service features.
12. Limitation of Liability
To the maximum extent permitted by applicable law:
- Except for obligations expressly stated in these Terms or the DPA, the Service is provided “as is” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. This disclaimer applies only to the extent permitted by law.
- Except for Excluded Claims defined below, to the fullest extent permitted by applicable law, neither party shall be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits or revenues, arising out of or relating to the Service or these Terms, regardless of the legal theory and even if advised of their possibility.
- We do not guarantee that Your Content will never be lost or corrupted, and you are responsible for maintaining appropriate copies of content you cannot readily replace.
- We are not liable for product-listing errors, publishing failures, downtime, rate limits, API changes, or other acts or omissions attributable to third-party platforms that we do not control, except to the extent the loss results from our breach of an express obligation under these Terms or the DPA. This sentence does not exclude liability that cannot legally be excluded.
- Except for the Excluded Claims defined below, to the fullest extent permitted by applicable law, each party’s total aggregate liability arising out of or relating to the Service, these Terms, the DPA, or any privacy, security, data-protection, or confidentiality obligation will not exceed the greater of (a) the fees paid or payable by you for the Service during the twelve (12) months preceding the first event giving rise to liability or (b) $1,000 USD. No exclusion or limit in these Terms applies to liability for a party’s fraud or willful misconduct, your payment obligations, or liability that applicable law does not permit to be excluded or limited (collectively, “Excluded Claims”). All exclusions and limits in these Terms apply to the fullest extent permitted by applicable law, regardless of the legal theory, and in the aggregate across all claims, and do not expand either party’s underlying duties.
13. Indemnification
You agree to indemnify, defend, and hold harmless WeScale, its officers, directors, employees, and agents from third-party claims, damages, judgments, settlements, and reasonable attorneys’ fees to the extent arising from:
- Your unlawful use of the Service, use of the Service in any manner inconsistent with the Service’s intended use, or your willful misconduct.
- Your Content, including any intellectual property infringement claims.
- Your violation of these Terms.
- Your violation of any applicable laws or third-party rights, or your connection or use of a platform account without required authority.
We will promptly notify you of an indemnified claim, permit you to control its defense and settlement with counsel reasonably satisfactory to us, and provide reasonable cooperation at your expense. You may not settle a claim in a manner that admits fault by, imposes nonmonetary obligations on, or fails to unconditionally release a WeScale indemnified party without our prior written consent, not to be unreasonably withheld. Failure to give prompt notice relieves you of obligations only to the extent materially prejudiced. This indemnity does not determine, expand, or waive WeScale’s liability, which remains governed by the other provisions of these Terms and applicable law.
14. Termination
14.1 By You
You may terminate your account at any time by deleting it in Settings → My Account, or by contacting us at support@wescale.ai.
14.2 By Us
We may suspend or terminate your account at any time if:
- You violate these Terms.
- Your use of the Service poses a security risk or legal liability.
- We are required to do so by law.
- We discontinue the Service.
Upon termination, your right to access the Service ceases immediately. Data will be deleted, de-identified, or retained only as described in the Data Retention and Account Deletion section, our Privacy Policy, the applicable DPA, and applicable platform and legal requirements.
15. Dispute Resolution
15.1 Governing Law
These Terms and all claims arising out of or relating to the Service or these Terms shall be governed by and construed in accordance with the laws of the State of Florida, USA, without regard to its conflict of law provisions, except that the Federal Arbitration Act governs the arbitration agreement below.
15.2 Informal Resolution
Before initiating formal dispute resolution, the claimant must send a written notice describing the claimant’s name and business, the facts and legal basis of the dispute, and the relief requested. Notices to WeScale must be sent to support@wescale.ai; we will send notices to the email associated with your account. The parties will confer in good faith for at least thirty (30) days after receipt of a complete notice. Any applicable limitations period is tolled during that period.
15.3 Binding Arbitration; Class-Action Waiver
15.3.1 United States Users. If you are located in the United States and the dispute is not resolved informally, any dispute, claim, or controversy arising out of or relating to the Service, these Terms, or their formation, breach, termination, enforcement, interpretation, or validity will be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules in effect when the claim is filed, as modified by these Terms. The Federal Arbitration Act governs this agreement to arbitrate, while Florida law governs these Terms and the underlying claims. A single neutral arbitrator will conduct the proceeding in English, ordinarily by videoconference unless the arbitrator determines an in-person hearing is necessary, and may award any individual remedy a court could award. The arbitrator will issue a reasoned written decision. Judgment on the award may be entered exclusively in the state courts located in Broward County, Florida or the United States District Court for the Southern District of Florida. The parties will keep the proceeding and nonpublic materials confidential except as needed to conduct or enforce the arbitration or as required by law.
15.3.2 Exceptions. Either party may bring an eligible individual claim in a small-claims court located in Broward County, Florida. Either party may seek temporary or preliminary injunctive relief exclusively in the state courts located in Broward County, Florida or the United States District Court for the Southern District of Florida to prevent imminent unauthorized access, misuse of credentials, infringement or misappropriation of intellectual property, or breach of confidentiality, pending final resolution by the arbitrator. Those courts, not the arbitrator, will decide disputes concerning the class-action waiver or a timely arbitration opt-out; the arbitrator will decide other questions of arbitrability.
15.3.3 Class-Action and Jury Waiver. To the fullest extent permitted by law, disputes must be brought only in an individual capacity and not as a plaintiff, claimant, or class member in any purported class, collective, consolidated, representative, or private-attorney-general proceeding. The arbitrator may not combine claims of different businesses or preside over such a proceeding without all parties’ written consent. Each party knowingly waives trial by jury for disputes subject to arbitration and, for any dispute properly heard in court, to the fullest extent permitted by law.
15.3.4 Opt-Out. You may opt out of arbitration and the class-action waiver by emailing support@wescale.ai within thirty (30) days after you first accept a version of these Terms containing this provision. Your notice must identify your business and account email and state that you opt out of arbitration. Opting out will not affect your access to the Service or any other provision of these Terms; any dispute covered by a valid opt-out will be resolved exclusively in the state courts located in Broward County, Florida or the United States District Court for the Southern District of Florida.
15.3.5 Severability and Courts. If a final decision holds a portion of this arbitration provision unenforceable, it will be severed and the remainder enforced to the fullest extent permitted. If the class-action waiver is unenforceable as to a particular claim or remedy, that claim or remedy will proceed exclusively in the state courts located in Broward County, Florida or the United States District Court for the Southern District of Florida after all arbitrable matters are completed. Users who validly opt out, small-claims matters transferred out of small-claims court, and other disputes not subject to arbitration will be resolved exclusively in those courts, and each party consents to their personal jurisdiction and venue.
15.3.6 Users Outside the United States. If you are located outside the United States, this arbitration agreement does not apply unless you and WeScale agree otherwise in writing after a dispute arises. Subject to any mandatory rights you cannot waive under applicable law, disputes will be resolved exclusively in the state courts located in Broward County, Florida or the United States District Court for the Southern District of Florida, and you consent to their personal jurisdiction and venue. Nothing in these Terms deprives you of protections that applicable law makes nonwaivable.
16. Changes to These Terms
We may update these Terms from time to time. We will provide reasonable advance notice of material changes by email, through the Service, or by another reasonable method. The notice will identify the effective date. We will request renewed electronic acceptance when required by applicable law or when the nature of a material change warrants it; if you do not accept such a change, you must stop using the affected Service by its effective date. For other changes, continued use after the effective date constitutes acceptance.
17. Miscellaneous
17.1 Entire Agreement
These Terms, together with any applicable order form and the DPA, constitute the entire agreement between you and WeScale regarding the Service and supersede prior or contemporaneous agreements on that subject. If an order form conflicts with these Terms, the order form controls for that order; the DPA controls solely for personal-data processing as stated above. Our Privacy Policy describes our privacy practices and is not itself a substitute for consent where applicable law requires consent.
17.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
17.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
17.4 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
